1. General

  1. The following contractual conditions apply to all contracts concluded with customers (hereinafter: CUSTOMER) through the online store of Boss Gainz (hereinafter: SELLER) under the domain www.bossgainzworldwide.com.
  2. The presentation of products in the SELLER's online store is merely an invitation to the CUSTOMER to place an order. By placing an order, the CUSTOMER makes a binding offer to conclude a contract for the items in the shopping cart. The SELLER immediately confirms receipt of the order by automated email. The automated order confirmation by the store system does not constitute a contractual relationship. An agreement is only concluded when the SELLER accepts the CUSTOMER's offer by delivering the ordered items to the CUSTOMER. The purchase contract is concluded only with Boss Gainz.
  3. Only private individuals are considered CUSTOMERS.

2. Changes

The SELLER reserves the right to update these terms and conditions as necessary. Changes will be communicated to the CUSTOMER in a timely manner and will only take effect with the CUSTOMER's consent.

3. Order process

  1. The CUSTOMER can add the desired items to the shopping cart by clicking on the corresponding button and start the ordering process by clicking on the shopping cart. During the ordering process, the CUSTOMER must enter the necessary contact details for shipping and payment. It is also possible to create a customer account and save the entered order data for future orders. The order is completed by clicking on the "Purchase" button.
  2. If a third party payment provider is selected for payment, the CUSTOMER will be redirected to their website and the purchase will be completed.
  3. Orders exceeding quantities typical for private consumption may be rejected or canceled. The CUSTOMER will be informed of this.
  4. Input errors, especially items accidentally added to the shopping cart, can be corrected by the CUSTOMER by entering the desired quantity in the shopping cart and using the available buttons. During the ordering process, the CUSTOMER can correct input errors in the different steps by navigating to the relevant step using the "back" and "forward" buttons in the browser.
  5. By completing the order, the CUSTOMER accepts the general terms and conditions, data protection provisions and withdrawal policy.
  6. The contract language is English.

4. Storage of contract text

The SELLER saves the contract text. The order data is sent separately to the CUSTOMER in text form (e-mail). The general terms and conditions can also be consulted and printed in the online shop. You can view this document here .

5. Right of withdrawal

If the CUSTOMER is a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to his commercial or self-employed professional activity), the CUSTOMER is entitled to a right of withdrawal in accordance with the legal regulations.

6. Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to distance contracts:

  • for the delivery of goods that could deteriorate quickly or whose expiry date would be quickly exceeded;
  • for the delivery of sealed goods that are not suitable for return for health or hygiene reasons, if the seal has been removed after delivery;
  • for the delivery of goods that are, by their nature, inseparably mixed with other goods after delivery.
  • If advance payment has been agreed, delivery will take place after receipt of the invoice amount.

7. Please note: returning products

The goods must be returned preferably in the original packaging with all accessories and packaging components to Boss Gainz Warehouse , Pesetastraat 86, 2988 CN Ridderkerk, Netherlands . The SELLER requests the use of protective packaging to ensure sufficient protection against possible transport damage if the original packaging is no longer available. Damage and contamination of the item to be returned must be avoided. CUSTOMERS are asked to return physical products to the seller as a prepaid package and keep the deposit receipt. The costs for returning the goods are borne by the CUSTOMER. The SELLER points out that the right of withdrawal and its consequences naturally exist independently of compliance with this notice; it is only intended to facilitate the processing of returns.

8. Prices and shipping costs

  1. The prices valid on the day of the order, as shown in the online shop, apply.
  2. The prices displayed in the online shop are in euros and include statutory VAT.
  3. When purchasing goods delivered by post or other means, the following applies: The prices shown in the online store do not include packaging and shipping costs. Shipping costs are calculated dynamically within the ordering process and displayed in the shopping cart overview before ordering.
  4. Information about delivery countries and shipping costs are loaded dynamically and may vary at any time.

9. Payment Terms

    1. The SELLER only accepts the payment methods offered in the online shop during the ordering process. These are:

    2. The CUSTOMER selects the desired payment method from the available payment methods.
    3. Paypal: If payment is made via PayPal, the CUSTOMER must have a PayPal account and authenticate with his PayPal details. The CUSTOMER must then go through the PayPal payment process and confirm the payment to the SELLER. You can also pay via PayPal without a PayPal account. The terms available through the payment method apply to PayPal's guest feature. If the CUSTOMER chooses to pay by credit card in PayPal, depending on the amount of the payment or the type of delivery, he may be asked to display a required second authentication function by the credit institution's website. The CUSTOMER must then verify the payment process with his personal second authentication function, such as password, PIN code, TAN or biometric data such as fingerprint or facial scan, using a dedicated app.
    4. Credit card: If delivery is made with payment by credit card, CUSTOMER authorizes that the full invoice amount, including any delivery and shipping costs, will be charged to the applicable credit card company on the due date. At the end of the ordering process, the CUSTOMER will be asked to enter his credit card number, the credit card expiration date and the verification code in the corresponding form. Depending on the amount of the payment or the type of delivery, the customer may be asked for a necessary second authentication feature by displaying the credit institution's website. The CUSTOMER must then verify the payment process with his personal second authentication feature, such as a password, PIN code, TAN or biometric data such as fingerprint or facial scan, using a special app. The specific type of identification used depends on the respective payment service provider (e.g. CUSTOMER's credit card institution). In this case, the amount will be charged with the order confirmation.
    5. Klarna invoice: In collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the Klarna payment method. Payment is made to Klarna. Your personal data will be processed by Klarna in accordance with applicable data protection laws and as described in Klarna's Privacy Policy .
    6. Sofortüberweisung (Klarna Sofort): If the payment is made by Sofortüberweisung (Klarna Sofort) of Klarna Group, the CUSTOMER must have an activated online bank account with PIN/TAN procedure. At the end of the ordering process, the CUSTOMER will be asked to enter his account number, bank code, PIN code and TAN on the form pre-filled by the SELLER (bank details, transfer amount, purpose). Immediately afterwards the transaction is confirmed to the CUSTOMER.
    7. Bancontact: If delivery is made with payment via Bancontact, the CUSTOMER enters his card details or pays with the Bancontact app. If the CUSTOMER enters the card number of his Bancontact card, he will be redirected to his bank's trusted online banking environment. After successfully logging in and entering the PIN code, the CUSTOMER confirms the transaction. They then return to the online shop.
    8. eps transfer: If delivery is made with payment via EPS transfer, the CUSTOMER will need an online bank account with one of the participating banks. At the end of the ordering process, the CUSTOMER selects the bank and logs in to the private online banking area. There the CUSTOMER checks the payment details already entered. If these are correct, the CUSTOMER authorizes payment via EPS and completes the purchase.
    9. SOFT: If delivery is made with payment via SOFT, the CUSTOMER logs into his online banking and authorizes the payment with a transaction authentication number (TAN) before returning to the webshop.
    10. iDeal: If delivery is made with payment via iDeal, the CUSTOMER first selects the bank. They are then forwarded to the bank's online banking environment. The CUSTOMER logs in securely with his access details. The total amount and other transfer details have already been entered in the input screen, so that the CUSTOMER only needs to confirm the payment via iDEAL. After confirmation of payment, the CUSTOMER will be redirected to the webshop. The CUSTOMER will immediately receive a payment confirmation.
    11. Apple Pay: If delivery is made with payment via Apple Pay, the CUSTOMER pays directly from his Apple account. After placing the order, the CUSTOMER will be redirected to Apple, where payment of the order amount can be authorized. Once SELLER is notified of the authorization, shipment will take place depending on the specified delivery time for the item. Depending on the payment method stored with Apple Pay, this will be charged immediately after authorization or after shipment with the actual invoice amount after deduction of any discounts, gift vouchers, etc.
    12. Google Pay: If delivery takes place with payment via Google Pay, the CUSTOMER pays directly from his Google account. After placing the order, the CUSTOMER will be redirected to Google, where payment of the order amount can be authorized. Once SELLER is notified of the authorization, shipment will take place depending on the specified delivery time for the item. Depending on the payment method stored with Apple Pay, this will be charged immediately after authorization or after shipment with the actual invoice amount after deduction of any discounts, gift vouchers, etc.

10. Promotional vouchers and their redemption

      1. Promotional vouchers are vouchers that cannot be purchased, but are issued by the SELLER as part of promotional campaigns with a specific validity period.
      2. Promotional vouchers can only be redeemed within the specified period and only once as part of an ordering process. Individual brands may be excluded from the voucher promotion. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may have a minimum order value.
      3. The value of the goods must be at least equal to the amount of the promotional voucher. Any difference towards a higher value can be compensated with the payment methods offered. The value of a promotional voucher is not paid out in cash and is not interest-bearing. The promotional voucher is non-refundable if the goods are returned in whole or in part.
      4. Promotional vouchers can only be redeemed before the ordering process is completed. Subsequent crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless otherwise stated in the promotion terms and conditions.
      5. If the total value of the order falls below the respective minimum order value of the promotional voucher used due to a subsequent return of ordered goods, the SELLER reserves the right to calculate and subsequently charge the original price of the ordered goods to the customer.

11. Value vouchers, product vouchers and their redemption

      1. a. Coupons: Vouchers are vouchers with a specific purchase value that are issued exclusively by the SELLER to the CUSTOMER, for example as a gesture of goodwill. They are customer specific, non-transferable and non-transferable. Cash payment is not possible.
        To redeem a voucher, enter the code in the appropriate field before completing the ordering process. The amount specified for the voucher will be deducted from the value of the order. The remaining voucher amounts will be retained and can be redeemed on subsequent orders by re-entering the voucher code as before. Orders whose value exceeds the voucher amount can be settled using the payment methods offered.
      2. b. Product vouchers: Product vouchers are vouchers for a specific product (e.g. ESN Designer Whey) that are issued exclusively by the SELLER to the CUSTOMER, for example as a goodwill gesture. They are customer specific, non-transferable and non-transferable. Cash payment is not possible.
        To redeem a product voucher, enter the code in the Support Center of the customer account in the appropriate field. The product specified for the product voucher is automatically added to the customer's shopping cart and included in the order.

12. Delivery and Shipping Terms - Information on how to calculate the delivery date

      1. Unless otherwise agreed with the CUSTOMER, the delivery of goods sent by post or in any other way will take place at the delivery address specified by the CUSTOMER in the order, using postal services (parcel, parcel, letter, freight, etc.) .
      2. The delivery time is indicated separately for each item or in the product description on the item page.
      3. The delivery time stated on the article page starts for all other payment methods on the working day following the day of conclusion of the contract.
      4. Orders can be placed by all CUSTOMERS from the European Economic Area and possibly other countries specified in the online store and/or in the shipping table. Orders will only be delivered to the countries specified in the online shop and/or in the shipping costs table.
      5. If the carrier returns the purchased item to the SELLER because delivery to the CUSTOMER was not possible, the CUSTOMER will bear the costs of reshipping. This does not apply if the CUSTOMER has exercised any existing right of withdrawal at the same time as the refused acceptance or if the circumstance leading to the impossibility of delivery is not attributable to the CUSTOMER, or if the CUSTOMER was temporarily prevented from accepting the service offered, unless the SELLER had announced the service to him at an appropriate time in advance.

13. Refunds

The SELLER will automatically initiate any refunds to the account used by the CUSTOMER for payment. If payment is made on invoice, the refund will be made to the account from which the transfer took place. If the CUSTOMER has paid via external payment providers, the refund will be made to the corresponding account. If the CUSTOMER used a voucher for the purchase, the corresponding amount will be credited to his voucher account.

14. Retention of Property

The SELLER reserves ownership of the items sold until full payment of the purchase price.

15. Warranty/liability for defects

      1. The rights to defects in the purchased item are governed by legal provisions.

16. Customer Account

      1. The CUSTOMER can create a customer account in the online store free of charge.
      2. When creating a customer account, the CUSTOMER, in accordance with the SELLER's privacy policy, will be asked to provide personal information. By providing his data, the CUSTOMER guarantees its authenticity and accuracy. They are also obliged to keep the information up to date when placing an order. Additional costs incurred by the SELLER as a result of incorrect or incorrectly entered data will be charged to the CUSTOMER. After the customer account has been created by clicking 'Create', the CUSTOMER will receive an email.
      3. By clicking on the link contained therein, the CUSTOMER confirms his identity and receives confirmation of the creation of his customer account by e-mail.
      4. The CUSTOMER has the right to register and manage only one customer account at a time on esn.com. If the SELLER becomes aware of multiple registrations, the SELLER has the right to exclude the CUSTOMER from using the webshop. CUSTOMERS whose customer accounts have previously been blocked or terminated by us are not allowed to create a new customer account. Minors are not allowed to register.
      5. The CUSTOMER and the SELLER may terminate the contract for the customer account at any time with immediate effect for the future without giving reasons. The SELLER reserves the right to delete the registration of CUSTOMERS who have not provided complete or incorrect data.

17. Data storage and data protection

18. Alternative Dispute Resolution

The SELLER is not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

19. Final provisions

    1. Dutch law applies, with the exception of the UN Convention on Contracts for the International Sale of Goods.
    2. The above choice of law applies only to the extent that the protection provided by mandatory provisions of the law of the country where the CUSTOMER has his habitual residence is not withdrawn.
